Browning (somewhat significant in places) and light foxing to interior, ink underlining to a few pages in final appendix. A notably scarce title in commerce. $1,000. * First edition. Cooper's work was intended to assist lawyers in their dealings with the first Federal bankruptcy act, which was enacted in February 1800. Intended to encourage economic risk and supersede the patchwork of debtor laws in force in the different states, it was modeled on the bankruptcy law of the world's leading commercial power, Great Britain. Its appendices draw further comparisons to the bankruptcy laws of France and Spain. Cooper, a chemist and lawyer by training, was a polymath who published books on law, political science, economics, medicine and the natural sciences. A friend of Joseph Priestley and Thomas Jefferson, he was a professor of chemistry at Dickinson College and the University of Pennsylvania. He joined the faculty of South Carolina College in 1819 and became its president in 1820. Convicted in 1800 under the Sedition Act for libeling President Adams in a 1799 handbill, Cooper wrote The Bankrupt Law during his imprisonment. He refers to his situation in the preface and says it was an honor to be punished for "exposing some few among the errors of a weak, a wicked and a vindictive administration" (Preface v). Light toning, negligible light foxing to margins of last few leaves, upper corner of leaf a1 (pp. iii-iv) lacking without loss to text, internally clean. A nice copy of a scarce title. $1,650. * Only English edition. First published in 1666 as Traite de la Preuve par Comparaison d'Ecritures, this treatise gives a historical overview of the use of handwriting analysis in criminal cases with reference to Greek and Roman law, English common law and French procedure. The discussion of Roman law is particularly extensive. It concludes that handwriting evidence is generally insufficient to secure a conviction and should not be admitted in criminal cases. Le Vayer was a lawyer in the parlement of Paris who wrote extensively on the rights of the accused. Our English translation of his work includes an extensive preface by the (anonymous) translator discussing the uses and abuses of handwriting evidence in English treason trials, including those of Algernon Sidney and Thomas Sprat. Chetwynd, who was about fifteen years old, stabbed his schoolmate with his pocket knife when the other boy tried to take a piece of his cake. The trial hinged on whether this constituted murder or manslaughter under common law; the jury could not decide and referred the matter to the judges. Chetwynd was eventually convicted of manslaughter and burned on the hand. This account includes an appendix with summaries of six cases cited in the Chetwynd trial. Merritt Esq" to head of title page, "to 1840" in same hand next to publication date. $1,500. * Only edition. The Panic of 1837 was a major economic depression that lasted into the 1840s. This 1837 act of the Alabama legislature was designed to minimize its effects on the state's bank. It specified terms for loan repayment, with a payment calendar and rates of interest. It also specified how the bank should issue loans and bonds and the amount of specie each bank branch should hold. One provision (No. 21) states that slaves, along with real estate, can be used as security against a loan. The Act was a success; the Bank of Alabama was one of the few banks in the United States to survive the Panic. It was fatally weakened, however, and its banking charter was revoked in 1842. J.C. Merritt Esq., may well be the banking magnate Joseph Cornelius Merritt (1839-1922) of Chanute, Kansas. He was President of the First National Bank in Chanute, as well as the city's mayor. OCLC locates 1 copy, at Birmingham-Southern College. This record is obsolete; the college closed in May 2024 and this pamphlet was sold in the auction of its library special collections in August 2024. Not in Cohen.
