A brilliant cellist, Rex was known on occasion to play musical examples for the students in the class on his cello. This course and its successor (a course on Mozart and Beaumarchais, again taught with Professor Heartz) would become legendary on campus. Lightly read. No markings in book. Sunned front cover. 108pp.

Der Verfasser untersucht einen Teilaspekt dieser Problematik. Vor dem Hintergrund der eher zufälligen Verwendung akzessorischer bzw. nicht-akzessorischer Sicherungsrechte in der Praxis wird ein Weg gezeigt, der eine einheitliche Dogmatik der Rechtskraftwirkung auf Dritte bietet. Ausgangspunkt ist die These, dass die subjektive Reichweite der Rechtskraft sowohl dem Prozessrecht als auch dem materiellen Recht angehà rt. Darauf aufbauend stellt der Verfasser eine Form der Urteilswirkung dar, die er als Tatbestandswirkung im weiteren Sinne umschreibt. Der zunehmenden Bedeutung internationaler Implikationen nimmt sich der Verfasser dadurch an, dass er zwischenstaatliche Sachverhalte einbezieht. Die Untersuchung des englischen Rechts dient dabei auch der Ãberprüfung des Modells einer Tatbestandswirkung von Urteilen.
