Erste Ausgabe des Kommentars zum Bayerischen Landrechts des aus Schwandorf in der Oberpfalz stammenden kurbayerischen geheimen Ratskanzlers Caspar Freiherr von Schmid (1622-1693). Er "verfügte über profunde Kenntnisse im Staats-, Straf-, Zivil- und Prozeßrecht, außerdem über umfassendes historisch-politisches Wissen, das er in Traktaten und Publikationen reflektierte. Er versuchte, bayer. Ansprüche auf Tirol, territoriale Forderungen gegenüber Nachbarn, bayer. Ambitionen auf die Erbfolge in Österreich und den dynastischen Fürstenstaat des Absolutismus gegen den Anspruch der Stände zu legitimieren. Deren Rechte sah er als Privilegien, die der Fürst auch widerrufen könne. 1654-56 erarbeitete Schmid ein neues Oberpfälzisches Landrecht. Eine geplante Fortentwicklung des Codex Maximilianeus von 1616 kam nicht mehr zustande, vermutlich da Schmid zunehmend Verantwortung für die Außenpolitik übernahm. Erst nach seinem Ausscheiden aus dem leitenden Staatsamt erarbeitete er 1684-92 einen umfangreichen Kommentar, der bis in die Mitte des 18.
