La Confédération serait en effet un pacte entre diverses parties ayant fondé le Canada contemporain. Cette théorie a pris une telle ampleur qu'elle est devenue un vague lieu commun de la politique canadienne. L'historien André Champagne, dans sa préface du livre de Jacques Lacoursière, Histoire populaire du Québec de 1841 à 1896, présente la théorie du pacte comme une évidence incontestable. Il écrit: «Dès sa naissance, l'Acte de l'Amérique du Nord britannique, mieux connu sous le nom de Confédération, repose sur une ambiguïté: pacte entre deux peuples fondateurs aux yeux des Canadiens français ou pacte entre provinces selon l'interprétation des Canadiens anglais.» Il n'est pas le seul: dans l'édition de mars de la Revue canadienne de science politique, le politologue Paul Romney soutient la même thèse. La théorie du pacte entre deux peuples fondateurs et tout ce qui en découle est une fausseté historique. Elle a été inventée après la Confédération de 1867 et tente de reconstruire les origines historiques du pays pour expliquer et justifier le contrôle provincial sur le processus d'amendement constitutionnel. Cette théorie a connu, dans l'histoire politique et constitutionnelle du pays, plusieurs variantes. La première théorie inventée est celle du pacte entre provinces, qui se transforma plus tard au Canada français en théorie du pacte entre deux peuples fondateurs.
