Johannes aus Tepl, Stadtschreiber und Notar in Saaz und später in Prag, hat dies Werk geschaffen, nachdem ihm am 1. August 1400 seine junge Frau gestorben war. Als Ackermann, als Vertreter des damals zahlreichsten Standes, klagt der Dichter den Tod als Mörder an. Der Tod aber verteidigt sich, spricht von der Nichtigkeit des Lebens und der Vergänglichkeit des Menschen. Dem widerspricht der Ackermann mit Leidenschaft: ?Der Mensch ist das allerachtbarste, das allerbehendeste, das allerfreieste Werkstück Gottes. Er allein ist das liebliche Gebild, desgleichen niemand als Gott zu schaffen vermochte, darin alle sinnvollen Werke, alle Kunst und Meisterschaft eingewirkt sind mit Weisheit." Gott spricht schließlich das Urteil: ?Ihr habt beide gut gefochten. Darum Kläger, hab Du die Ehre! Dir, Verklagter, falle anheim der Sieg. Sintemal jeder Mensch ist verpflichtet, dem Tod das Leben, der Erde den Leib, seinem Gott die Seele zu übergeben." ? Hans Franck, der den Text ins Neuhochdeutsche übertragen hat, kennzeichnet die Sprachgewalt dieser Dichtung: ?Die Sprache dieses Werkes ist von einer Dichte und Wucht, einer Kraft und Urtümlichkeit, einer Bildfreudigkeit und Eindringlichkeit, die keineswegs nur im 15. Jahrhundert, sondern bis in unsere Tage hinein ihresgleichen sucht." Der Schutzumschlag unserer Ausgabe zeigt das Titelblatt und ein Textbild des von Konrad Fyner in Esslingen 1474 geschaffenen Druckes.
