AT THE THIRD ANNUAL LAWYER'S CONFERENCE OF THE AMERICAN CIVIL LIBERTIES UNION OF NEW JERSEY ON FEBRUARY 28, 1970 AT RUTGERS LAW SCHOOL IN NEWARK, NEW JERSEY. IN THE ADDRESS, WEINGLASS PRESENTS THE BASIS FOR THE CHARGES AGAINST THE EIGHT DEFENDENTS IN THE CONSPIRACY 8 TRIAL THAT STEMMED FROM THE RIOTING AND VIOLENCE AT THE 1968 DEMOCRATIC NATIONAL CONVENTION IN CHICAGO, ILLINOIS. ATTORNEY WEINGLASS DESCRIBES THE BASIS FOR THE CHARGES THAT THE GOVERNMENT LEVIED AGAINST THE DEFENDENTS. THE CHARGES WERE BASED ON A NEWLY CREATED LAW THAT WAS INITIALLY PROPOSED BY CONGRESS IN RESPONSE TO AN EARLIER RIOTING IN NEWARK, NJ. THE BILL PROVIDED THAT ANY PERSON WHO CROSSED THE STATE LINES WITH A STATE OF MIND INTENDING TO INCITE OR PROMOTE A RIOT IS GUILTY OF A CRIMINAL OFFENSE PUNISHABLE BY FIVE YEARS IMPRISONMENT AND A MAXIMUM OF $10.000.00 FINE. A RIOT IS DEFINED AS AN ASSEMBLAGE OF THREE PERSONS, ANY ONE OF WHOM THREATENS PROPERTY DAMAGE OR PERSONAL INJURY TO A FOURTH PERSON. THE ANTI-RIOT ACT AS IT BECAME KNOWN FAILED ITS INITIAL PASSAGE IN THE SENATE AFTER IT WAS CONDEMNED BY UNITED STATES ATTORNEY GENERAL RAMSEY CLARK AS BEING PATENTLY UNCONSTITUTIONAL. CLARK ALSO POINTED OUT THAT ALL FIFTY STATES ALREADY HAD ANTI-RIOT ACTS. IN 1968, SENATOR STROM THURMOND OF SOUTH CAROLINA ADDED THE FAILED ANTI-RIOT ACT TO THE CIVIL RIGHTS ACT OF 1968 AND THAT BECAME THE RATIONALE FOR THE CHARGES AGAINST THE 8 DEFENDENTS. IN HIS SPEECH, WEINGLASS PROCEEDED TO DISCUSS THE RATIONALE FOR THE GOVERNMENT'S INDICTMENT OF THE 8 DEFENDENTS. ONE OF THE DEFENDENTS,BOBBY SEALE, THE CHAIRMAN OF THE BLACK PANTHER PARTY, HAD BEEN INVITED TO PROVIDE SPEECHES TO THE CONVENED YOUTHFUL PARTICIPANTS IN GRANT PARK DURING THE CONVENTION. HE WAS IN CHICAGO FOR SEVEN HOURS PROVIDING TWO SPEECHES IN GRANT PARK. HE DID NOT PERSONALLY KNOW THE OTHER DEFENDENTS. HIS ATTORNEY CHARLES GARRY WAS RECOVERING FROM GALLBLADDER SURGERY AND JUDGE JULIUS HOFFMAN DENIED SEALE A DELAY IN THE TRIAL WHILE HIS ATTORNEY RECOVERED. SEALE THEREFORE DECLARED THAT HE WOULD DEFEND HIMSELF. SEALE'S PROTESTS AGAINST ACCUSATIONS THAT HE PARTICIPATED IN A CONSPIRACY WITH THE OTHER DEFENDENTS RESULTED IN JUDGE JULIUS HOFFMAN'S ORDERING HIS CHAINING TO HIS CHAIR AND GAGGING. WEINGLASS FURTHER DISCUSSES MANY OF THE REPRESSIVE ACTIONS AND ORDERS FROM JUDGE JULIUS HOFFMAN THAT PREVENTED HIM AND ATTORNEY WILLIAM KUNTSLER FROM DEFENDING THEIR CLIENTS AND EVENTUALLY BRINGING CONTEMPT OF COURT CHARGES AGAINST THEM AS WELL. IN ONE SUCH SITUATION, THEY WERE NOT ALLOWED TO QUESTION POTENTIAL JURORS DIRECTLY. THE QUESTIONS WERE PRESENTED BY JUDGE JULIUS HOFFMAN WHO CHOSE FROM A LIST OF MULTIPLE QUESTIONS THAT WERE SUBMITTED BY THE ATTORNEYS. THE JUDGE SELECTED THE JURY IN ONLY THREE HOURS. THIS UNCOMMON IF NOT RARE DOCUMENT PORTRAYS THE DEFENSE ATTORNEYS AND DEFENDENT'S FRUSTRATIONS IN DEALING WITH THE PRESIDING JUDGE JULIUS HOFFMAN DURING THE CONSPIRACY 8 TRIAL.

This lot includes the following: 1) Two typed letters signed by William Kunstler, both addressed to "Greg" [Mitchell, author and journalist] and signed "Bill." One is undated and quite brief, and the second is a full sheet of w 8.5 in. x h 10.5 in. text on ruled paper, dated July 4, 1976, providing edits to a proposed article. This latter includes the original envelope. 2) Two press photos depicting Kunstler at events relating to his defense of the Chicago Seven. w 10 in. x h 8 in. 3) One press photo of Kunstler with Spike Lee during the filming of Lee's 1992 film Malcolm X. w 5 in. x h 7 in. 4) One press photo of Weinglass with Rev. Paul Washington and Lennox Hinds following their return from Iran. This print is from the archives of the Baltimore Sun, and incorporates editorial marks in silver ink. 5) Three issues of Crawdaddy: January 1976, February 1976, and September 1976. CX Consignment.
