This book examines how British common law shaped unequal treatment of U.S. citizens of African descent by analyzing laws targeting and defining racial difference through the 18th century. Central to this history was the concept of "legal slavery," whose impact extended beyond the enslaved to free blacks and the nation as a whole. The author argues that while the main features of American chattel slavery emerged during the colonial era, the full development of legal slavery occurred later, in the context of state-formation and amidst debate over rights. Through nine chapters and an epilogue, the book traces the shifting legal status of blacks, the development of a "slave code," and the ways in which these legal constraints reinforced a society structured by hierarchy and white supremacy.
