Excerpt from The Use of Deed Restrictions in Subdivision Development
But before analyzing deed restrictions in detail, it may be well to consider their setting in relation to the general prob lem of controlling urban land utilization and the relation of these instruments to other types of control with which they come in contact. The purpose of this chapter, therefore, is to trace very briefly the evolution of urban land regu lation, point out the need for and the major purposes of such control, as well as to explain the reasons for selecting the subdivision field as the place for studying restrictive agreements in oper ation. In other words, this chapter will indicate the place of deed restrictions in the developing technique of regulating urban land utilization.
The field of public control of land uses is a comparatively new activity in this country. About a quarter century ago the country suddenly awoke to the seri ous problems which had arisen from lack of planning. Cities were first to show symptoms of the need, and as a result the development of systematic control began about the turn of the century in this country.
