Certes, il est naturel que John A. Macdonald ait préparé cette mesure, complétant l'oeuvre de la Confédération. Il est plus surprenant de la voir adoptée par les libéraux, qui inscrivaient l'autono mie des provinces en tête de leur programme. Un député ministériel, henri-thomas Taschereau, de Montmagny, signala le danger et voulut s'opposer au bill. Ancien adhérent du parti national, Henri Taschereau restait un patriote à la manière de ses amis Jetté, David et Mercier. Il apporta cet argument: Les décisions des juges de la province de Québec, fondées sur notre code civil et notre code de procédure civile français, seront cassées par une Cour Suprême composée en majorité de juges étrangers à la province et ignorant ces codes! Il proposa de limiter la juridiction de la Cour Suprême aux causes tombant sous la loi fédérale. Les conservateurs Aldéric Guimet et j.-alfred Mousseau l'appuyêrent en vain. L'amendement Taschereau fut repoussé par 118 voix contre 40. Parmi les quarante figuraient un certain nombre de conservateurs canadiens - français, Baby, Caron, Masson, etc et, à part Taschereau lui-même, un seul libéral: François Bourassa, le député de Cham bly qui avait tant combattu la Confédération et restait un champion de l'autonomie provinciale.
