Mr. Browne's work is the product of an able English lawyer, and it exhibits upon every page a thorough knowledge of the principles of the law pertaining to this important topic. He commences at the very threshold of the inquiry and pursues it to the end in an accurate, logical and exhaustive manner. I have taken his work for the basis of mine because our law in this particular is wholly derived from the English. An elaborate examination of the English cases was, there fore, deemed essential and it seemed to me that it would be better to utilize the skillful, discriminate and practical presentation of the sub jcet by Mr. Browne than to attempt to construct an entirely new one from my own investigations. I have made copious additions to Mr. Browne's text wherever in my judgment a more ample illustration of the rules under consideration tended to better suit the requirements and assist in the development of the American law. My great object throughout the work has been to secure a statement of the entire law with precision and simplicity. The attempt to perform this task has forced upon me the careful examination and patient study of many hundreds of volumes and I have endeavored to give the gist of every.
