Mitchell replied, denying that he ever made any agreement with the executors to sur render the lease, and alleging that his offer to do so was obtained by misrepresentations as to the value of the lot, and the price which the railroad company were to pay therefor.

Subsequently, the railroad company, and also the heirs of Nicholas Longworth, were made parties defendant, and the company filed an answer, insisting that the company was a bona dde purchaser without notice of Mitchell's alleged rights.
