IN submitting this volume of reports to the profession, a word of explanation in regard to the organization of the Courts, in which the cases were decided, is deemed proper. The District Court, in Oregon, was organized in September 1, 1859, under the Act of March 3, of that year, (11 Stat. And had Circuit Court powers and jurisdiction until the creation of a separate Circuit Court for the district, by Act of March 3, 1863, (12 Stat. The cases entitled in the Circuit Court for the District of California, were de cided while I held that Court during portions of the years 1867 - 8 - 9, in pursuance of the designation of Justices chase and field of the Supreme Court.
