Excerpt from The Works of Hubert Howe Bancroft, Vol. 36: Popular Tribunals
On the other hand the questions arose: Are these secrets to die with you? May not the knowledge of your experience be of value to succeeding societies? Have you the right to bury in oblivion that experi ence, to withhold from your fellow-citizens and from posterity a knowledge of the ways by which you achieved so grand a success? And so after many meetings, and warm deliberations, it was agreed that the information should be placed at my disposal for the purpose of publication.

Paperback. Condition: New. Print on Demand. This book examines the phenomenon of popular tribunals, an extreme form of vigilante justice. The author studies the background, characteristics, and impact of these tribunals, focusing primarily on their manifestation in California and the surrounding areas during the 1849-1859 Gold Rush era. The author argues that popular tribunals were a direct response to the failure of legal authorities to maintain order and administer justice in the rapidly changing and often lawless frontier society. These tribunals, organized by ordinary citizens, sought to fill the void left by corrupt or inefficient law enforcement and judicial systems, and their methods often included the swift and brutal punishment or banishment of criminals. The author explores the ethical, social, and political implications of popular tribunals, and examines their role in shaping the development of law and order in the American West. Ultimately, the book provides a nuanced and thought-provoking analysis of a controversial historical phenomenon, shedding light on the complex relationship between justice, law, and society in times of social upheaval.
