It may be objected, indeed, that fuch publi cation, pmdmte lite, while the canfo is depend ing, is, infome meafure, an anticipation of the trial, and an unfair method of prejudging the merits, and influencrng the public opinion, in favour, or to the prejudice, 'of the contending parties.~ But, befides that the wifdom and im partiality of our judges are too great to be ia fluenced by popular prepofl'efiions, it is to be obferved that the veracity of depofitious, till controverted in a court, is at befi problemati cal; the validity of their evidence depending on the judiciousinveftigation of its degree and quality, and the final refalt which thence de termines thedecifion of the judge.
