Excerpt from Königtum und Bischofswahl im Fränkischen und Deutschen Reich Vor dem Investiturstreit: Dissertation zur Erlangung der Doktorwürde bei der Philosophischen Fakultät der Grossherzoglich Hessischen Ludwigs-Universität zu Giessen Ich glaube nicht, daß diese Auffassung den Tatsachen ganz gerecht wird. Es scheint doch, daß sich mit der Er oberung Galliens durch die Franken die Verhältnisse mit einem Schlage wandelten. An die Stelle des fernen römischen Kaisers trat jetzt die viel unmittelbarere und nähere Gewalt des fränkischen Königs. Diese Veränderung fand auch in der Frage der Bischofswahlen in einer neuen Rechtsbildung ihren Ausdruck. Während bisher die Wahl und Ordination eines Bischofs auch ohne Mitwirkung der weltlichen Gewalt Rechtsgültigkeit hatte machte es das Königtum jetzt zum Prinzip, daß erst die Verleihung des Bistums durch den König, nicht die vorausgehende Wahl der Gemeinde, wenn eine solche stattfand, ein Anrecht auf dieses gibt.
