Paperback. Condition: New. Print on Demand. This book gives a meticulous history of the legal battle to recover large tracts of land in 19th century Canada, seized by the British Crown from the Jesuit order during the conquest of Canada from France. The author skillfully traces the arguments advanced by both sides and carefully examines the historical context in which the dispute took place. The book provides numerous examples of how legal concepts like the rights of religious corporations and the principle of conquest played out in the nascent Canadian legal system. The author also delves into the question of whether the banning of the Jesuits, who had used the lands for over a century for educational and other religious purposes, was even legal. Through all of this, the author underlines the significance of this case in the development of Canadian law and the broader evolution of the legal framework governing the relationship between church and state in Canada.
