Si se opta como lo hace el Estatuto de la ICC por este último enfoque, se plantea la cuestión de cómo poner en práctica este objetivo idílico, y en particular cómo se sanciona a un fiscal que no logra cumplir con estas altas expectativas. . . Una segunda cuestión de importancia tiene que ver con el alcance del control judicial en la fase de investigación. Hasta ahora los modelos adoptados van desde ninguna supervisión judicial (Núremberg y Tokio) hasta investigaciones acompañadas de un juez (Tribunales ad hoc e ICC) y la designación de un juez instructor que controla y dirige las investigaciones bajo su autoridad (ECCC). A pesar de estas y otras diferencias, todos los tribunales internacionales e internacionalizados comparten una característica común: fusionan elementos de la tradición romano-germánica y del common law que dan lugar a un Derecho procesal sui generis.
