Lockyer and Bream insured their building against fire damage with the Phoenix Company, claiming £7,000, although the local Minister and Churchwarden (required under the policy to agree the terms) refused to sign being uncertain of the size of the claim. At the first trial, the jury awarded the plaintiffs £3,000. At Appeal, two years later, the judgement was reversed in favour of Phoenix.
