Das Oberverwaltungsgericht Münster bestätigte in mehreren Fällen Versammlungsverbote gegenüber Demonstrationen mit einem rechtsextremistischen Hintergrund, und zwar mit der Begründung, das à ffentliche Bekenntnis zum Nationalsozialismus rechtfertige ein entsprechendes Verbot. Das Bundesverfassungsgericht hob all diese Verbotsverfügungen wieder auf und wies das Oberverwaltungsgericht darauf hin, eine Versammlung kà nne nicht schon allein deshalb verboten werden, weil die Teilnehmer politisch missliebige Meinungen äuÃerten. Die Kontroverse über die verfassungsrechtliche Bewertung rechtsextremistischer Demonstrationen mündete Anfang 2005 in eine Reform des Versammlungsrechts und des Meinungsstrafrechts. Schützen die Kommunikationsfreiheiten (Art. 5 und 8 GG) die à ffentliche ÃuÃerung der nationalsozialistischen Ideologie in demselben Umfang wie jede andere Meinung auch? Der Autor erinnert zunächst daran, was Nationalsozialismus eigentlich bedeutet, aus welchen Elementen die nationalsozialistische Ideologie besteht und welche politischen Ziele sie formuliert. AnschlieÃend stellt er die allgemein anerkannte Dogmatik der Meinungs- und Versammlungsfreiheit dar und arbeitet ihre wesentlichen Lehrsätze heraus. Im Mittelpunkt der Studie steht die Frage, warum das Oberverwaltungsgericht Münster und das Bundesverfassungsgericht die Kommunikationsfreiheiten in so unterschiedlicher Weise ausgelegt haben. Die Antwort lautet: Die Gerichte mussten deshalb zu unterschiedlichen Auffassungen gelangen, weil sie unterschiedlicher Meinung darüber sind, was das Prinzip der politischen Neutralität des Staates nach dem Grundgesetz bedeutet. In gut lesbarer Weise untersucht der Autor die unterschiedlichen Positionen der beiden Gerichte, arbeitet ihre Argumente und Widersprüche heraus. Zum Schluss prüft der Autor das erkenntnis- und demokratietheoretische Fundament, auf dem das herkà mmliche Verständnis staatlicher Neutralität steht, auf seine Tragfähigkeit. Aus dem Grundgesetz leitet er ein materielles, wertbestimmtes Konzept der staatlichen Neutralität ab, dem es nicht widerspricht, eine MeinungsäuÃerung wegen ihres nationalsozialistischen Inhalts zu verbieten. Die Studie liefert damit einen Beitrag zu der umstrittenen Frage, wie die Bundesrepublik angesichts ihrer unheilvollen Vergangenheit mit Versuchen, den Nationalsozialismus politisch wiederzubeleben, umgehen sollte.
