Alle Gesetzbücher, die in der Folgezeit des Naturrechts entstanden sind, werden an glanzvollem äusseren und geistigen Wirkungen vom französischen Code civil des Jahres 1804 überboten. Aus dem vernunftrechtlichen Gesetzesglauben geboren, vebin…det diese Zivilrechtskodifikation zugleich alle Errungenschaften der Revolution von 1789 und auch die Machtgrösse eines Napoleon Bonaparte. Der mächtige Potentat, zu dieser Zeit noch "Erster Konsul" (1799-1804), wirkte bei der Entstehung des Gesetzes persönlich mit und mischte sich mehrfach bei den Gesetzesberatungen ein. Die militärische Kraft und der napoleonische Eroberungswille aber auch die geistige Stärke des Gesetzes verhalf dem Code civil, seit dem Kaiserreich amtlich bezeichneten, unveränderten Code Napoleon eine ungewöhnliche Verbreitung, so dass für einen gewissen Zeitraum beinahe ganz Europa unter direkten Einfluss dieses Gesetzbuches geriet. In den linksrheinischen Gebieten trat der Code civil bereits in Kraft, andere von Napoleon besetzte Gebiete mussten den Code Napoleon einführen, Baden vollzog dies auf politischem Druck freiwillig. Auch das System, die Konzeption und die begriffliche Fassung weist den Code civil als die allen anderen zeitgenössischen Gesetzbüchern überlegene Kodifikation aus. Das vernunftrechtliche System hat in seinen 2.281 Artikeln folgende Gestalt: 1. Personenrecht mit Einschluss des Ehe- und Vomrundschaftsrecht 2. Sachenrecht a. Heinrich Gottfrie…d Wilhelm DANIELS (1754 - 1827) was initially a lawyer, and since 1784 a law professor at the University of Bonn. With the invasion of the French in 1797, the University of Bonn was dissolved, Daniels lost his law chair and moved to Cologne. In 1804, a law school was founded in Koblenz. Daniels was appointed there and faced the task of teaching the new (French) law. His German translation of the Code civil in 1805 was masterly. Daniels was so respected in French circles that he was appointed to the Court of Cassation in Paris on the occasion of Napoleon's visit to Cologne in September 1804. Deutsche Ausgabe des Code Napoleon in der Übersetzung des wohl bedeutendsten rheinischen Juristen dieser Zeit Heinrich Gottfried Daniels. Heinrich Gottfried Wilhelm DANIELS (1754 - 1827) war zunächst Rechtsanwalt, seit 1784 Rechtsprofessor an der Universität zu Bonn. Mit dem Einmarsch der Franzosen wurde 1797 die Universität Bonn aufgelöst, Daniels verlor seinen Rechtsstuhl und zog nach Köln um. Als 1804 in Koblenz eine Rechtsschule gegründet worden ist. Christian Daniel ERHARD (1759-1813) studierte ab 1778 die Universität Leipzig und promovierte 1782 zum Doktor der Rechte. Anschließend wurde…er zum Oberhofgerichts-Advokaten ernannte und nahm 1783 eine Stelle als Beisitzer im Niederlausitzer Landgericht an. Im Jahre 1787 wurder er zum Extraordinarius und schließlich 1793 zum Ordinarius für Rechte an der Universität Leipzig ernannt. Seine juristischen Publikationen bezogen sich vor allem auf das sächsische und preußische Recht, herausragend etwa das von Carmer angeregter "Versuch einer Kritik des allgemeinen Gesetzbuchs für die preußischen Staaten" (1792). Seine Übersetzung zum "bürgerlichen Gesetzbuch Napoleons I., so Erhard im Vorwort, erscheint später als angekündigt, weil er den bislang fünf erschienenen Übersetzungen nicht einfach eine sechste anreihen wollte. Dies wäre jedoch schon deshalb nicht geschehen, weil er eine Reihe von Übersetzungsfehlern bei seinen Vorgängern entdeckt habe. Bei schwierigen Stellen habe er deshalb Anmerkungen hinzugefügt. Daneben fügte Erhard Parallelstellen aus dem Handelsgesetzbuch und der Gerichtsordnung hinzu. Besonders wichtig ist die Hinzufügung der Vergleichung des Napoleonischen Gesetzbuches mit dem Römischen Rechte und den ältern Französischen Gewohnheiten und Gesetzen, die der französische Jurist Dard angefertigt hat. Die Anmerkungen von Dard hat nicht Erhard, sondern ein gewisser Demuth übersetzt. Die zweite Ausgabe erschien im Jahre 1811, auch mit dem ergänzenden Supplementsband.

Zeitgenössischer Halblederband mit Buntpapierüberzug auf den Buchdeckeln auf fünf Bünden gehetet, Buchfals beschädigt. Das Großherzogtum Baden entstand in den napoleonischen Kriegen aus zwei Teilen, zum…einen aus dem unter dem Markgrafen Karl Friedrich I. im Jahre 1771 zusamengeführten Bereichen Baden-Baden und Bande-Durlach und den zu Beginn des 19. Jahrhunderts hinzugefügten Gebieten. Baden wollte seine staatliche Einigung durch Anlehnung an den 1804 erlassenen Code civil beschleunigen und hat auch aufrgund eines Gutachtens des großen badenischen Juristen Brauer im Jahre 1809 den Code Napolèon freiwillig eingeführt. Am 1. Juli 1809 sollte der Code Napoleon in Kraft treten, dies wurde jedoch auf den 1. Januar 1810 verschoben. Brauer wollte möglichst getreut den Code Napoleon verwirklichen und hat sich daran auch in seiner Übersetzung gehalten. Als Gesetz ist nur der deutsche Text in Kraft getreten. Brauer hat sämtliche Fremdwörter in deutsche Sprache zu überführen versucht, was teilweise ein wenig kurios klingt. Im Jahre 1814 wurde der Titel "Code Napoleon" in "Badisches Landrecht" abgeändert. Seuther hieß das Gesetzbuch: "Land-Recht für das Großherzogtum Baden". Im Jahre 1846 erschien ein neuer Druck des Badischen Landrechts. Vgl. Coing, Handbuch III,2/ 1443-49.

A few scuffs to boards, considerable rubbing to extremities with wear to spine ends and corners, front joint cracked, front board beginning to separate but secure, front free endpaper edgeworn and partially detached, minor worming (?) to final text leaf and rear free endpaper at center of hinge. Light toning, annotations to rectos and versos of most interleaves, most likely by Eugene Marie Bonaventure Lucas de Peslouan, a few manuscript notes in same hand laid in, "Lucas-Peslouan" to title page of Code. $2,500. * First edition. The Code de Procedure Civile was issued two years after the publication of the Code Civil (Code Napoleon). It is one of the main components of the legal system established during the Empire. (The Table Alphabetique et Raisonnee is a companion index volume.) The annotations in our copy date from 1810 to 1820. This period coincides with the career of Eugene Marie Bonaventure Lucas de Peslouan, an attorney from a notable Breton family that produced several generations of lawyers and notaries. His annotations, which range in length from phrases to several sentences, are notably meticulous. They comment on the articles, give clarifications, pose procedural questions and refer often to laws from the Revolutionary period and early years of the Empire. Several notes are cross-references and there are a number of comments in question-and-answer form. For example, in the section "Proceedings Before the Courts," "The claims directed against undivided successions in the national domain, do they fall under judicial or administrative jurisdiction?
