Résumé : Les recherches sur le développement des nouvelles technologies dans les processus démocratiques commencent à se développer et concernent différents domaines de l'action publique. Le projet de cet ouvrage est de s'intéresser spécifiquement à leur introduction dans le champ de la justice pénale dans le contexte d'un mouvement plus large de changements, d'évolutions qui recomposent l'institution judiciaire depuis quelques années. Seront plus spécifiquement ici évoquées les expériences de placement sous surveillance électronique en Europe ainsi que les débats et les problématiques qui les accompagnent. La question principale consiste à se demander si le développement des nouvelles technologies n'accompagne pas des mouvements de recomposition de l'action de l'État dans les champs du pénal et de la sécurité. Or précisément, de ce point de vue, le bracelet électronique traduit une réorganisation des formes d'expression de la puissance publique qui, plutôt que de s'incarner, comme elle l'a longtemps fait, dans des institutions et des hommes sur un territoire public donné, semble peu à peu s'inscrire et se diffuser dans la société. Public : Enseignants et chercheurs (droit, sociologie et science politique), Magistrats et tous les acteurs de la justice. Mais le placement sous surveillance électronique, au-delà de son originalité, participe d'un mouvement plus large d'introduction des technologies dans la justice. Ce sont autant de nouveaux moyens techniques, jugés fiables et sur lesquels les décisions vont pouvoir se fonder qui saisissent la justice. Quel sera le rôle, l'impact de ces technologies dans l'environnement social et politique qui est le nôtre aujourd'hui ? Quelles sont les conséquences, d'une recherche par la puissance publique d'une nouvelle efficacité et légitimité qui la conduit à s'ancrer de plus en plus dans la société elle-même, et à s'appuyer sur ces technologies ? Comment identifier les répercussions possibles, en termes de construction d'un nouveau modèle social et pénal, d'un pouvoir en quête de légitimité ? Ces quelques questions, parmi bien d'autres, traversent les réflexions qui animent cet ouvrage afin de mieux évaluer dans quelle mesure des processus qui parfois ne sont perçus que comme l'expression de choix techniques axiologiquement neutres, produisent en réalité des transformations plus durables des modes de régulation et donc de l'identité même du fonctionnement de nos sociétés.
