Ces trois petits documents sont intéressants car ils nous apportent des informations inconnues sur la généalogie de François Puissant. En effet, il eut une première femme, Anne de Malartie, qui meurt en 1788, et le couple n'aura eu qu'un fils. Il se sera donc remarié avec cette « F Dulido » avec qui il aura un second fils, mentionné dans ces documents. [298].

(Paris, L'Imprimerie Royale, 1792). 4to. Stitched in later marbled wrappers, with printed book label "Collection Quarré-Reyboyrbon, Lille" to inside of front wrapper. Contemporary handwritten inscription above head-piece "Bon pour imprimeur chez M. Descamps Douay le 12 avril 1792." (presumably in the hand of Quarré-Reybourbon). A bit of brownspotting and soiling, but overall very nice. 4pp. Scarce first printing of the legal document that led to the guillotine becoming France's standard method of judicial execution. This groundbreaking decree of the National Assembly, given 20 March 1792, suspended all pendig death punishments and authorized the use of necessary expenses to achieve a more humane method of execution throughout the kingdom. The methods for achieving this humane form of execution is explained in the the annexed text signed by Antoine Louis (see below), the permanent secretary of the Academy of Surgery. The decree is as follows: ?The National Assembly, considering that the uncertainty regarding the method of execution of Article III of Title 1 of the Penal Code, suspends the punishment of several criminals who are sentenced to death" that it is urgent to put an end to inconveniences which could have unfortunate consequences" that humanity requires that the death penalty be as painless as possible in its execution, decrees that there is an emergency.? The Penal Code of 1791, title 1, article 3 (Tout condamné aura la tête tranchée, ?Every condemned person will have their head cut off?) should be executed ?according to the manner indicated and the method adopted by the consultation signed by the Permanent Secretary of the Academy of Surgery, which remains annexed to this decree? and the National Assembly ?consequently authorizes the Executive Power to incur the necessary expenses to achieve this method of execution, so that it may be uniform throughout the Kingdom.? (p. 1) Prior to 1791, under the Ancien Régime, there existed a variety of means of capital punishment in France, depending on the crime and the status of the condemned person. In 1791, there was a campaign towards the abolition of the death penalty, but later that year, The National Assembly refused to pass such a law. However, torture was abolished and a single method of execution was declared, that of beheading, which had previously only been applied to nobles. In 1791-92, the development of a mechanical beheading device was set in force by a committee in order to make the death penalty "as painless as possible in its execution" and "uniform throughout the kingdom? Note that before the use of a mechanical beheading device, manual beheading and a variety of other methods of execution had been in force in France. Ironically, what is now known as the guillotine was developed with the help from Louis XVI ? who was a skilled amateur locksmith ? with regards to the shape of the blade. This change towards a more painless method was ignited by physician Joseph-Ignace Guillotin in October 1789 at the National Assembly. Later, a committee was formed under Antoine Louis, the inventor of the guillotine, and physician to the King and Secretary to the Academy of Surgery. This committee included Guillotin, and although he did not invent the guillotine and opposed the death penalty, his name became an eponym for it. After its adoption, the device remained France's standard method of judicial execution until the abolition of capital punishment in 1981. The last execution with a guillotine in France took place in 1977.

This report constitutes a document of primary importance on the actions of Robespierre and his supporters. "Courtois (1756-1816), a member of the Convention, embraced the revolutionary cause with great enthusiasm and was, from the beginning, appointed receiver of the district in his native town, then deputy to the Legislative Assembly, where he did not particularly distinguish himself. Elected by the same department (Aube) to the National Convention in 1792, he again spoke very little from the tribune; however, he was closely linked with Danton there, and therefore opposed Robespierre. During the trial of Louis XVI he voted for death, against an appeal to the people and against delay. It is clear that Courtois must have run great risks when his friend Danton was sent to the scaffold. He increasingly withdrew into silence and only broke it on the famous day of 9 Thermidor, when he contributed as much as he could to the overthrow of Robespierre. Appointed one of the members of the commission tasked with examining the papers seized from Robespierre and his accomplices, he was charged by his colleagues with drafting and reading the report to the Convention; he worked on it for nearly six months. It was only in the session of 16 Nivose year iii (January 1795) that he read this famous report, which has become one of the most curious monuments of the French revolution. The documents it contains are the most truthful part and best characterize this period. After 9 Thermidor, Courtois became in the Convention one of the most active and formidable opponents of the faction known as 'the tail of Robespierre'; and he rendered considerable service to the victims of the Terror?" (Biographie universelle). Elected to the Legislative Assembly in 1791, friend of Danton, Courtois took his revenge after 9 Thermidor by requesting to join the commission tasked with inventorying the papers found in Robespierre's possession. "In his 'Report made on behalf of the Commission charged with examining the papers found in Robespierre and his accomplices,' Courtois allows us to measure, incidentally and without realizing it, the immense popularity enjoyed by Robespierre among patriots. 'Criminal associations caused him to inhale, from all parts of France, the criminal incense they burned in his honor; it was a competition to intoxicate the idol? and thousands of irreligious fanatics seemed to have driven the gods they had worshipped for so many centuries from their temples only to prostrate themselves before their new god Maximilien. One must read these papers to be convinced?' (1) '?A national agent in turn informs us that it is the Supreme Being whose existence Robespierre proved who (in gratitude, no doubt) watches over his days and that the Republic is saved.' And Courtois refers us to no. XVIII of the supporting documents (2). This concerns a letter from citizen D? to Robespierre, which must be transcribed in full in order to follow the sender's own explanations. Première édition, illustrée de 4 planches, contenant à sa suite la seconde édition augmentée de l'Opinion de J.-J. Sue sur le supplice de la guillotine, initialement parue en 1795. Rare ouvrage de physiologie expérimentale explorant les notions de sensibilité et de vitalité lors de la décapitation ou décollation. Sue essaie de cerner la notion de souffrance des corps décapités en procédant à de nombreuses expériences sur des animaux : décollations de coqs, dindons, poules, lapins, veaux, porc et grenouilles. Il s'appuie également sur des squelettes de foetus anencéphales dont il préserve un spécimen, illustré par deux planches, dans son "muséum". Sue conclut contre la guillotine : "la décolation est un des plus affreux supplices par sa durée". Rare ouvrage de tératologie et de physiologie expérimentale de la fin du XVIIIe siècle portant toutefois sur un sujet de société de la période révolutionnaire : la guillotine est-elle un progrès ? Titre un peu roussi et sali, petite mouillure marginale en marge intérieure.

Vraisemblablement du Bagne de Cayenne réalisée dans la première partie du XXe siècle en effet, certains détails représentés ici sont présents sur la guillotine de Cayenne et absents de la représentation d'autres "bois de justice". Fabrication très soignée en bois et métal très représentative du travail de certains forçats au bagne de Cayenne. Quelques vis et la corde ont été changés, objet très décoratif en bel état.
