Das Privatrecht beruhte daher ?in erheblichem Umfange auf Rechtsquellen, die einer früheren Periode der Gesetzgebung angehören, nämlich auf [. dem alten] Landbuch, 1850 von Kothing herausgegeben, und [der amtlichen] Sammlung der Gesetze und Verordnungen, 1803 begonnen, seit 1848 fortlaufend, zu neun Bänden angewachsen; eine neue Ausgabe für Band 1?3 erschien 1871.? (Huber 1, 1886, p. 50 f.). - ?Das Landbuch von Schwyz war bisher nur wenig bekannt. Das officielle Manuscript wurde auf dem Rathhaus aufbewahrt und kam nur bei Gerichtsverhandlungen zum Vorschein. Abschriften desselben, meistens aus der ersten Hälfte des achtzehnten Jahrhunderts, sind zwar mehrere vorhanden, keine kann aber auf Vollständigkeit, viel weniger auf Korrektheit Anspruch machen. Um nun dem Rechtsbedürftigen, wie dem Richter, das heimische Recht zugänglich zu machen, entschloss ich mich zur Herausgabe des gegenwärtigen Landbuchs.? (M. Kothing, p. X). --Martin Kothing (Schwyz 1815-1875 ibid.), von Schwyz. 1835?1838 studierte er Rechtswissenschaft in Zürich und Heidelberg. Nach mehrjähriger Lehrtätigkeit in Lucens und La Chaux-de-Fonds kehrte er 1843 nach Schwyz zurück, wo er sich als Anwalt und Privatlehrer der Söhne seines Förderers Nazar von Reding betätigte. Seine rechtshistorischen Arbeiten begannen mit dem ?Landbuch von Schwyz in amtlich beglaubigtem Text? (1850). Nach dem Sonderbundskrieg wurde Kothing 1848 Archivar und Regierungssekretär und befasste sich mit der Reorganisation des Schwyzer Kantonsarchivs. [.]. Als Verwaltungsjurist und Gesetzesredaktor war er gleichzeitig im Gerichtswesen, für Regierungsgeschäfte und das Archiv tätig und betrieb juristische und historische Forschungen.
