La tortura como práctica incorporada al Derecho supone, por tanto, un desafío para la corrección y la validez que deben sustentarla y justificarla. El derecho parecería, con su sistemática, reglas y procedimientos, representar la situació…n paradigmáticamente opuesta al Leviatán hitleriano. ¿Cómo conciliar la normalidad de las leyes con el decisionismo radical del Caudillo? ¿Cómo referir la inevitable pretensión de justicia de un acto jurídico con el desprecio de los derechos y de la dignidad de los más débiles? ¿Cómo compatibilizar las garantías procedimentales con el arbitrio y la violencia? Y sin embargo hubo en la Alemania de los años terribles del gobierno de Hitler juristas famosos y cultos que teorizaron y justificaron el tercer Reich a traces de elaboradas e incluso elegantes construcciones iusfilosóficas y dogmáticas. El más famoso de los juristas nazi es sin dudas Carl Schmitt; sin embargo es Karl Larenz uno de los más influyentes y sinceros. Su producción en los doce años de Hitler es poderosa e ingente, en cierta medida también inteligente. NO se trata como en la teoria de Schmitt de la oportunista cobertura la discrecionalidad del Caudillo, sino que hay que un diseño orgánico y completo de reforma del sistema jurídico en sentido antiigualitario, comunitarista y autoritario. Es la modernidad jurídica misma la que Larenz quiere cancelar. Pues bien, de esto trata este libro, ya que los demonios que agitaron y corrompieron a Larenz y a la gran mayoría de los juristas alemanes de su tiempo no son del todo externos a la tradición y a la mentalidad del derecho como producto ultimo de poder y fuerza.
