Weniger bekannt dagegen dürfte sein, dass die ganze Strafgerichtsbarkeit in den drei Bünden aufgebaut ist auf der sogenannten Rügegerichtsbarkeit und insofern im Prinzip ins Mittelalter zurückgreift und überraschende Ähnlichkeit mit dem englischen Geschwornengericht [Geschworenengericht], der Vehmgerichtsbarkeit [Feme, Femegerichte] Deutschlands und den geistlichen Sendgerichten des Mittelalters aufzuweisen hat.? (p. 4). - Beachtenswert scheint aus heutiger, dem Laien kaum mehr vertrauter Sicht die grosse Bedeutung des Pensionenwesens als Staatsvergehen. ?Von der Mitte des 15. Jahrhunderts an wurde der Begriff im weltlichen Kontext für regelmässige, in fester Vertragsform vereinbarte und offizielle, wenn auch oft vertraulich gehandhabte Zahlungen gebraucht, die Laien wie Kleriker vom Fürsten zusätzlich zu ihrer normalen Entlohnung erhielten. [.] Sowohl als öffentliche, an offizielle Kassen bezahlte wie als geheime, an Einzelpersonen entrichtete Pensionen zielten sie darauf ab, politische Entscheidungen zu beeinflussen und den ausländischen Kriegsherren den Zugang zu den begehrten eidg. Söldnern (Fremde Dienste) zu sichern. Obwohl von Beginn an umstritten (die ersten Versuche, Pensionen zu verbieten, datieren bereits vom Beginn der 1470er Jahre), ermöglichten sie den Aufstieg wohlhabender Honoratioren und Kriegsunternehmer (Militärunternehmer). [.] In internen Konflikten zu Beginn des 16. Jahrhunderts [z.B. in Bern, Solothurn, Luzern Zürich und Basel] spielten diese Jahrgelder, deren Empfängern Bestechlichkeit und Verrat vorgeworfen wurde, eine zentrale Rolle. Flugschriften und Traktate beklagten ihre Auswirkungen in drastisch sexueller Metaphorik und bezeichneten sie als giftige Gaben und Judaslohn.
