Sparse bruniture, qualche macchietta, un paio di antiche firme di possesso e qualche difetto marginale al frontespizio. Edizione interessante e non comune. La trattazione è divisa in 9 libri e tratta un argomento di grande interesse tra quattrocento e cinquecento in tutte le corti europee. Già Matteo D'Afflitto (In Const., I, In quaestionibus, n. 3) osserva che il De duello si ispira al duecentesco De pugna di Roffredo da Benevento, e in effetti interi passi appaiono copiati (H. Kantorowicz, De pugna, in Rechtshist. Schriften, Karlsruhe 1970, p. 270). L'autore, giureconsulto e consigliere di Alfonso primo d'Aragona, ottenne la cattedra di giurisprudenza a Napoli e fu maestro di Ferrante I che lo nominò uditore generale in tutto il Regno. Esemplare leggermente slegato. Graziosa incisione xilografica al frontespizio raffigurante alcuni duellanti. Questo libro è un trattato italiano sulle leggi e i costumi del duello, scritto in latino rinascimentale dal giurista italiano Paride del Pozzo e pubblicato per la prima volta nel 1471-72. È particolarmente importante per le sue descrizioni dettagliate delle leggi e dei costumi del duello, che contribuiscono a stabilire il contesto dei sistemi di combattimento del XV secolo, e anche di episodi di specifici duelli storici, che fanno luce su come si svolgeva il combattimento nella pratica. Il trattato di Dal Pozzo ha avuto una notevole popolarità, essendo stato pubblicato in almeno sedici edizioni nel corso del secolo successivo e tradotto in altre tre lingue; alcune sezioni furono riprese anche da Achille Marozzo e costituirono uno degli elementi fondamentali del suo popolarissimo trattato sulla scherma bolognese. Ex-libris novecentesco di Ludovico de Gobbis applicato al recto del piatto anteriore. Tagli azzurri. Piccolissima perdita di carta al margine interno bianco delle carte C1 e C2, assolutamente ininfluenti e presenti prima della stampa del volume e nel complesso, esemplare in ottime condizioni di conservazione. Xilografia di duellanti al frontespizio, iniziali xilografiche, testo in corsivo. Il nome dell'autore, Paride Dal Pozzo, si ricava dall'intitolazione a carta B1r. Il nome degli stampatori, Pietro Ravani e Melchiorre Sessa il vecchio, si ricava dall'analisi del materiale tipografico. Fra le edizioni più rare e fra le primissime edizioni in lingua italiana stampate a Venezia dell'importante opera del celebre giurista italiano, conosciuto anche con il soprannome de "Il Puteo", Paride del Pozzo (in latino Paris de Puteo, Pimonte in provincia di Napoli, all'epoca nel Ducato di Amalfi ad un paio di miglia da Castellamare, 1410 Napoli, 1493). Poca documentazione certa esiste sulla sua vita tanto che la maggior parte delle sue notizie biografiche arrivano da studi del sei-settecento. Per comprendere la difficoltà di ricostruire le vicende giuridiche basti ricordare cosa scrive Ennio Cortese nel Dizionario Biografico degli Italiani, Volume 32 del 1986 edito da Treccani, nella voce dedicata a dal Pozzo nel tentativo di ricostruire il percorso universitario dell'autore: "il Chioccarelli (dal quale traggono Toppi, Tafuri e altri) parla di Roma, Pavia, Firenze, Bologna, Perugia; il Giannone aggiunge per errore Milano; il De Fortis preferisce Padova a Pavia; il Giustiniani, con argomentazioni imperfette, limita la rosa a Padova, Firenze e Ferrara. In realtà, le sole informazioni che il D. stesso offre alludono a soggiorni in Toscana e a Bologna; in questa città, d'altronde, poté udire nei primi anni '40 tutti i suoi maestri. Ma non vi conseguì la laurea, né d'altronde il suo nome è rintracciabile altrove in alcuno degli elenchi di dottorati pervenutici. A Bologna egli compare ancora nel 1445 soltanto come "bacalarius in decretis": il titolo, usuale nelle scuole di teologia, ma non in quelle italiane di diritto, è tuttavia esplicitamente ricordato nella riforma del Collegio dei dottori giuristi stabilita da Giovanna II nel 1428, sicché appare plausibile che il D. avesse compiuto buona parte dei suoi studi a Napoli". Quello che è sicuro è che una volta laureato, se dalla città partenopea si era allontanato, tornò a Napoli dove ben presto, si fece apprezzare per la sua preparazione e arguzia. Qui entrò al servizio della corte aragonese e di Re Alfonso, ricoprendo diversi incarichi pubblici quali, ad esempio, auditore generale e inquisitore generale di tutto il regno. Alessandro Manzoni lo ricorda come uno strenuo oppositore della tortura come mezzo d'indagine. Fra gli incarichi che occupò c'è anche quello di "Commissarius regni" con ampi poteri per la repressione della criminalità e giudice della Vicaria intorno al 1473. Autore prolifico, scrisse diverse importanti opere, per lo più a carattere giuridico che furono molto apprezzate al suo tempo e gli portarono fama, bel al di là dei confini del regno aragonese. Dal Pozzo intuì la portata della nuova invenzione della stampa a caratteri mobili, volendo ben presto riprodurre le sue opere principali, con questa nuova tecnica. Come scrive sempre Cortese, "L'opera maggiore, il De syndicatu, rivela una formazione graduale che si colloca tra la prima stesura imperfetta, surrettiziamente sottratta all'autore e stampata con i tipi di Riessinger verso il 1473, e la redazione definitiva, profondamente rimaneggiata, apparsa nel 1485 per le cure e le spese di Francesco del Tuppo". Fu autore anche di trattati di argomento diverso rispetto al diritto come "De Ludo" ed appunto, il noto trattato dedicato al duello, argomento di grande interesse tra quattrocento e cinquecento in tutte le corte europee. La obra alcanzó gran fama y se publicaron numerosas ediciones a lo largo del siglo dieciséis. Paride del (or dal) Pozzo (1410-1493), called il Puteo, Latinized as Paris de Puteo, was a 15th-century Italian jurist. His treatise was first printed in Latin, then in Italian at Naples by Sixtus Riessinger, not before 1475. The two texts are rather different; the Italian, which omits some matter from the Latin but expands on others, appears to be an adaptation of the Latin directed at soldiers and princes rather than jurists. The Italian edition remained popular and was reset, with updated spelling and punctuation, and printed in Venice several times in the 16th century. This is the earliest such edition held in the British Library. Essling 2095; Sander 5414. Octavo (150 x 94 mm). Woodcut title device depicting a pair of duellists in front of a panel of jurists, 10-line woodcut criblé opening initial, 4-line woodcut initials throughout. Complete with final blank [b8].
