Den jedesmaligen Bestrafungen liegt aber nicht die ganze Reihe der inzwischen verübten Verbrechen zu Grunde, sondern nur das einzelne Verbrechen, bei welchem sich der immer gewandter werdende Verbrecher hat überraschen lassen. Und dies einzelne Verbrechen rechtfertigt, bei der ausdrücklichen Beschränkung der präventiven Haft auf die obigen Uebertretungen, vielfach nur eine kürzere Strafdauer. So leben unsere Berufsverbrecher in einem steten Wechsel von Freiheit und Gefangenschaft, ein Wechsel, welcher schon an sich geeignet ist, auf gewisse Gemüther einen Reiz auszuüben ."
