Both Georgia and South Carolina were sending memorials to the US Congress at this time, condemning what they deemed to be encroachments by the Federal government on their State sovereignty, in particular by imposing tariffs and promoting internal improvements. Georgia argues that the Feds have no such authority and are overstepping their bounds.

Georgia objects to the Federal Government appropriating funds for the passage and settlement of American Negroes to Africa."That the people of the South, at the time of the adoption of the Constitution, considered not only the retention but the increase of slave population, to be all important to the welfare and interests of their States, is manifest from a reservation in that instrument itslef, which, it cannot be doubted, was inserted on their express requisition." - p. 7.Condemns the abolitionist societies and predicts that unless the pressure from the North in regard to slavery subside, their enemies "are unwittingly preparing a mine, which, once exploded, will lay our much beloved country in one common ruin." - p. 9.

The 1802 Articles of Agreement and Cession between the Commissioners of the United States and the Commissioners of th eState of Georgia explicitly stated "that the United States should, at their own expense, extinguish, for the use of Georgia, as early as the same could be practicably obtained on reasonable terms, the Indian title to all lands within the State of Georgia." The report details the removal of other Indian tribes to the West, including the Creeks of Georgia, but laments that the Cherokees have not yet been removed. It reviews the history of Georgia's right to the land it deems its own, and shows "that, since the Revolutionary war, Georgia has done no act, and entered into no compact with her sister States, by which she has divested herself of any portion of her sovereignty, affecting her rights now in question." It reviews Georgia's rights under both the Articles of Confederation and the US Constitution. It rejects any treaty that the US may have made with the Cherokees, and claims Georgia's right to all of the lands which the Cherokees possess within the State. Among the several Resolutions is "That, to avoid a catastrophe which none would more sincerely deplore than ourselves, we make this solmn appeal to the President of the United States, that he take such steps as are usual, and as he may deem expedient and proper for the purpose of, and preparatory to, the holding of a treaty with the Cherokee Indians, the object of which shall be the extinguishment of their title to all the lands now in their possession within the limits of Georgia.".
