In pursuit of this aim Mauthner pioneered a view of language which has had a very wide circulation in the twentieth century - namely that the analysis and understanding of language, particularly ordinary language, is the philosophers most important task. Mauthner was very much an outsider from the German academic establishment and has little sympathy with the increasingly influential phenomenology of the time. In this thorough and authoritative study, Gershon Weiler locates his ideas in their proper historical tradition and urges that their originality now be recognised and their interest reconsidered.

Ce débat sur les rapports entre Etat et religion, les sociétés européennes l'ont connu jusqu'à une période récente ; il est en cours dans les sociétés musulmanes. Gershon Weiler réfléchit ici sur le judaïsme, de l'Antiquité à nos jours. Au départ, avec la disparition du dernier Etat juif, la Loi religieuse juive est devenue le code juridique d'une communauté sans pouvoir politique. Dans la pensée juive traditionnelle, le concept de théocratie entraîne le refus de penser l'histoire et le politique, de Flavius Josèphe à Philon, Malmonide et Abravanel. Une exception : Spinoza, excommunié. Deux événements ont détruit les fondements sociaux et politiques de l'ordre ancien : l'émancipation et la sécularisation des Juifs ; le sionisme et la création de l'Etat d'Israël. Ils avaient un point commun : n'être ni acceptables ni même pensables pour les tenants de la halakha. Herzl et ses successeurs n'avaient guère réfléchi aux relations du futur Etat avec la religion. Le résultat ? Depuis 1948, un compromis ambigu et peu satisfaisant, que Gershon Weiler analyse minutieusement. Il critique avec force un double paradoxe : un Etat fondé sur la liberté de conscience remet aux autorités religieuses et aux tribunaux rabbiniques le pouvoir de régir des domaines entiers de la vie sociale, comme le statut personnel. Des religieux dont le pouvoir vient de lois votées par le Parlement d'un Etat non religieux demandent et obtiennent toujours plus d'exemptions à leur profit et de coercition contre les autres citoyens.
