Nach Auffassung des ganz überwiegenden Teils der Wissenschaft und der Rechtsprechung könne ein solcher… omnimodo facturus nicht mehr angestiftet werden, da dieser seinen Tatentschluss schon gefasst habe. Es komme lediglich eine psychische Beihilfe durch Bestärkung des Tatentschlusses in Betracht.Im ersten Teil der Arbeit zeigt sich bei einer Betrachtung des Vorsatzbegriffs, dass die entscheidende Grundannahme der Lehre vom omnimodo facturus nicht zutrifft, der Tatentschluss des späteren Täters im Vorbereitungsstadium sei regelmäßig identisch mit dessen Deliktsvorsatz bei Tatbegehung. Deutlich wird vielmehr, dass der Wille zur Tatbegehung im Planungsstadium der Tat einige Elemente nicht aufweist, die für den Vorsatz konstituierend sind. Entscheidend kommt es deshalb für die Bestrafung eines Anstifters nicht darauf an, welchen Einfluss er auf den Tatplan des Täters vor der Tat ausübt, sondern welchen Einfluss er auf den Vorsatz des Täters im Zeitpunkt der Tatbegehung hat.Für die anschließende Frage, wann sich dieser Einfluss als ein Bestimmen zur Tatbegehung darstellt, wird im zweiten Teil der ursächliche Zusammenhang zwischen Einwirkungsbeitrag und Deliktsvorsatz untersucht. Dabei zeigt sich zunächst, dass sowohl Anstiftung als auch psychische Beihilfe einen psychischen Kausalzusammenhang voraussetzen. Für beide psychischen Teilnahmeformen ist die Verursachung des Tatentschlusses des Haupttäters Mindestvoraussetzung der Zurechnung.Sodann wird im dritten Teil der Arbeit herausgearbeitet, dass der Unterschied zwischen der tätergleich zu bestrafenden Anstiftung und der psychischen Beihilfe strukturell dem Unterschied zwischen (Mit-)Täterschaft und Beihilfe entspricht. Hier wie dort hängt die Höhe des zu verantwortenden Unrechts von dem Gewicht des kausalen Tatbeitrags für die Tat ab. Der Anstifter muss folglich den Tatentschluss durch die von ihm gelieferte Motivation oder Rathilfe prägen. Anhand verschiedener Erscheinungsformen der psychischen Teilnahme wird schließlich dargelegt, worin ein solcher prägender Einfluss des Anstifters besteht.; Dissertationsschrift.
