Wenn auch nicht mehr unter so reger Anteilnahme Napoléons kam mit dem Code de procédure civil im gleichen Gesetzgebungsverfahren schon früh eine Kodifikation des Zivilprozesses zustande, das ebenfalls ein bedeutendes Gesetzeswerk wurde, eine wichtige Stellung im Rahmen des Europäischen Rechts einnahm und auch großen Einfluß auf andere Kodifikationen nahm. Der Code de procédure civil besteht aus zwei Hauptteilen. Der erste behandelt in fünf Büchern das Verfahren vor den verschiedenen Gerichten, mit Ausnahme des Gerichtsverfahrens vor dem Kassationshof und den Conseils de prud`hommes. Der zweite Teil enthält Vorschriften für eine Vielzahl besonderer Verfahrensarten einschließlich bestimmter Akte freiwilliger Gerichtsbarkeit. Der Code de procédure civil war keine Neuschöpfung, sondern nahm das Alte Recht auf und folgte in den Grundzuügen wie sogar in Einzelheiten der Ordonnance vom Jahre 1667. Der Grund lag in der Kontinuität der Gesetzgebung und in der Absicht, die mit dem alten Gerichtsverlauf geübten Juristen auch nach den Stürmen der Revolution wieder in geordnete Bahnen zu lenken. Außerdem verlangte auch die nachrevolutionäre Zeit vom Zivilprozeß, bei dem es naturgemäß weniger um inhaltiliche Auseinandersetzungen ging, ein wesentlich geringeres Maß als beim Code civil. Auch wenn der Code de procédure civil europaweit beachtet worden ist und durch Napoléon auch iun fast ganz Europa als Gesetz eingeführt worden ist, gab es bereits in Frankreich Kritik an der Kodifikation. Im wesentlichen lassen sich drei Bereiche beschreiben: 1. Die bloße Beschränkung des Code de procédure civil auf bloße "juristische Technik" stieß allenthalben auf Kritik, 2. Ebenso das Umschlagen von Formgebundenheit in einem überlebten Formalismus 3 und auch sein unzulänglicher Gesamtaufbau. Die nachfolgenden Gesetzgebung ist deshalb von großer Wichtigkeit, weil schon bald Änderungen, Zusätze und Reformen eingeführt worden sind. Das ganze 19. Jahrhundert bildete einen gesamten Prozeß an der Ausbildung eines modernen Code de procédure civil.
