Sei der Rechtsschule von Bologna im 11. Jahrhundert war es ein Desiderat, eine kritische Ausgabe der Digesten, des wichtigsten Teils des corpus iuris civilis, zu bewerkstelligen. Diese Entwicklung fand in der genialischen Arbeit von Theodor Mommsen und der Edition der editiom maior ihren Abschluss. Auf welchen Weg, insbesondere über die Idee des sog. Codex secundus, und mit welchen Arbeitsmitteln Mommsen dies berwerkstelligte, muss hier nicht dargestellt werden, sondern es kann verwiesen werden auf die umfangreichen praefationes von Mommsen, die diesem Nachdruck in den Übersetzungen von Gisela Hillner beigefügt sind. Nunmehr kann man Mommsen selbst zuhörfen, auf welche Weise dieses Jahrtausendwerk zustandekam und Mommsen unsterblich machte. Theodor MOMMSEN (1817-1903) hat eine Reihe von bedeutenden Werken verfasst, ihm wurde sogar für seine wissenschaftliche und literarische Leistung der Nobelpreis für Literatur (für sein unvollendet gebliebenes Werk Römische Geschichte) verliehen. Selbst innerhalb der Jurisprudenz ist beinahe die Kenntnis verloren gegangen, daß Theodor Mommsen Jurist gewesen ist. Wohl bekannt ist noch das "Römische Strafrecht" oder das "Römische Staatsrecht". Aber weit herausragend und eigentlich alle sonstigen Leistungen beinahe in den Schatten stellend war sein Geniestrei der kritischen Ausgabe der Digesten Kaiser Justinians als dem wichtigsten und gehaltvollsten Teil des Corpus iuris civilis. Seit der Schule von Bologna, die sich Ende des 11. Jahrhunderts als die erste europäische Juristenschule etablierte und impulsgebend auf ganz uropa ausstrahlte, stand ein Desiderat am Juristenhimmel: die ursprüngliche Textgestalt der Digesten, sowie es Kaiser Justinian zu Beginn des 6. Jahrhunderts erstellen ließ. Codex Florentinus, Vulgata und schließlich der von Mommsen genial rekonstruierte Codex Secundus sind Marksteine dieses Bemühens, an dem Generationen von Juristen arbeiteten und schließlich in Mommsen einen vorläufigen Höhe- und Endpunkt fand. Der hrößte Teil dieser faszinierenden Textgeschichte ist eingefangen im VICO-Programm IUS COMMUNE, in dem alle entscheidenden Textausgaben nachgedruckt sind.

The dawn of European legal science at the Bologna School at the beginning of the 12th century, that era of the glossators and commentators, would have been inconceivable in such glory without the stroke of luck represented by the complete preservation of this text. It was a divine inspiration of a unique nature, one that nevertheless paved the way for differing traditions. Esemplare delicatamente reglé in rosso. Capilettera xilografici. Marca tipografica (L09067) sul frontespizio. Carattere corsivo, greco e romano. Esemplare in ottimo stato di conservazione nella sua affascinante legatura coeva. La prima edizione delle Novelle di Leone VI il Saggio (866-912) è opera di Scringer, che corregge solo imperfettamente il manoscritto; Henri Estienne la stampa nel 1558 e pubblica una serie di correzioni alla fine del volume. La prima traduzione in latino apparve nel 1560 ad opera di Henri Agylee. La prima aggiunta dell'opera di Leone, le Novelle, all'opera di Giustiniano avvenne nel 1571 nell'edizione di questa copia. In questa edizione, il testo di Scringer [in greco] di fronte alla traduzione di Agylee, occupa le pagine da 235 a 665. Seguono: la Costituzione di Zenone, le Castigationes di Henri Estienne, il Libro dei Feudi, le Costituzioni di Federico II, gli Extravagantes e il Libro della Pace di Costanza. Im Kreise von ausgezeichneten Philologen verfolgte er den ehrgeizigen Plan, sämtliche wichtigen und wesentlichen Handschriften (und Druckausgaben) bei der Edition der kritischen Ausgabe heranzuziehen. Dieser Plan schien beinahe schon bei den Institutionen zu scheitern. Die Institutiones konnten schließlich im Jahre 1832 ediert werden.
