Unter dem Pseudonym veröffentlichte er 1766 eine staatskirchenrechtliche Programmschrift über die geistliche Immunität. In ihr wandte er sich gegen die kurialistische Theorie, besonders des Kardinals Bellarmin, wonach der Papst der Herrscher aller Staaten sei. Diese Argumentation für die Staatssouveränität wurde sofort indiziert und in den folgenden Jahren kontrovers diskutiert. Hier eine Antwort Osterwalds auf eine Kritik aus der neugegründeten Bayerischen Akademie der Wissenschaften (welcher er selbst angehörte), aus dem folgenden Jahr, die wegen der Indizierung im französischen Straßburg gedruckt werden musste. - Einband etwas verblasst bzw. lichtrandig. "Die Schrift entwickelt zunächst objectiv die von klerikaler Seite aufgestellten Gründe für die geistliche Immunität, zieht dann mit scharfen Gründen und dabei ruhig zu Felde gegen die curialistische Theorie, besonders des Cardinals Bellarmin, wonach der Papst der König der Könige, Fürst der Fürsten, souveräner Herrscher aller Staaten sei, legt dar, daß der Geistliche in weltlichen Dingen weder für seine Person, noch seine Güter eine Exemtion beanspruchen könne, daß der Staat souverän und von der geistlichen Gewalt gänzlich unabhängig sei. Seine Argumente sind wesentlich Febronius entlehnt. Die Schrift rief einen Sturm hervor. Der Fürstbischof Clemens Wenzel von Freising erließ ein öffentliches Verbot vom 13. August 1766 dagegen, welches auch im Kurfürstenthum an den Kirchenthüren angeschlagen wurde. Der Kurfürst cassirte dasselbe mit Erlaß vom 29. August als 'einen sonderbaren Eingriff in unseren Landeshoheitsrechte', drohte den Geistlichen Temporaliensperre, den Weltlichen 'willkührliche Straff' an, wenn sie es nicht fortnähmen, rechtfertigte das Buch, weil es 'keine Glaubens- und Religions-Sachen, sondern nur landesherrliche Gerechtsame und Befugnisse' abhandle, verbot die Gegenschriften und die Abhandlung Bellarmin's über die Päpstliche Gewalt in zeitlichen Dingen, sah selbst die zweite Auflage durch und ernannte O. am 30.
